Concerning my participation in classes and/or activities produced, presented and instructed by Maureen Benoit (“Instructor”) online and/or in-person, I agree to take full responsibility for any injury I might suffer during these practices. I understand that it is my full responsibility to ascertain whether there are any medical reasons that prevent me from participation (either full or partial). In addition, I waive any claim that I might have at any time in reference to injury incurred during the above practices against the Instructor, Instructors, Subs, Employee or any Person or Entity in any way involved therewith. This release waives the provisions of the California Civil Code, Section 1542 which provides: “A general release does not extend to claims which the creditor does not know to exist in his favor at the time of executing the release, which if known to him must have materially affected his settlement with the debtor.” 

I have carefully read, fully understand and agree to the above. Following the pronouncements above I hereby declare the following: I am fully and personally responsible for my own safety and actions during my participation in any fitness / wellness related activity presented/instructed by the Instructors, while in, on or around the  premises or while using the facilities that may lead to unintentional harm due to engaging in a fitness activity.

With full knowledge of the risks involved, I hereby release, waive, discharge the Instructors from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me related to participating in any fitness/wellness activity as presented and instructed by the Instructors.

I agree to indemnify, defend, and hold harmless the Instructors from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death.

By signing below I acknowledge that I have read the foregoing Liability Release Waiver and understand its contents; that I am at least eighteen (18) years old and fully competent to give my consent; That I have been sufficiently informed of the risks involved and give my voluntary consent in signing it as my own free act and deed; that I give my voluntary consent in signing this Liability Release Waiver as my own with full intention to be bound by the same, and free from any inducement or representation.

This waiver will remain effective until the termination of my participation.
